DNR Rules and the Lake Maxinkuckee Association

Maxinkuckee is a public freshwater lake, so Indiana Code 14-26-2 applies. Any fence or railing within 10 feet of the ordinary high water mark needs an Indiana DNR LARE permit before it goes in.

The Lake Maxinkuckee Association also enforces environmental and aesthetic standards along the shoreline, and those rules are often more detailed than the state minimums. Treat association approval as the first step, before local or DNR permits. We start both reviews at the same time so they don't stack into months of waiting.

Set back from the water, standard Culver and Marshall County rules apply, and most fences up to 6 feet go in without a local permit.

Building for Sandy Shoreline Soil

The clarity that makes Maxinkuckee beautiful comes from sandy, well-draining ground, and that same sand is what we work with at the shoreline. It won't hold a standard concrete post through the freeze-thaw cycle.

On every shoreline job here we use helical anchors or bell footings engineered for low-bearing soil. Aluminum is our go-to material at the water: no rust, no paint, and a finish that stays sharp for years. Vinyl handles perimeter runs set back from the edge.

Upland Culver lots are a different story. The drainage is excellent and installs go fast, so a fence away from the water often costs less and moves quicker than a shoreline project.

What does the Lake Maxinkuckee Association require for shoreline fencing?
The association reviews materials, height, placement, and visual impact on the lake. Get their approval before filing local or DNR permits. Ornamental aluminum and certain vinyl styles tend to review more favorably than solid privacy fence near the water.
Do I need a DNR permit for a fence on Lake Maxinkuckee?
Yes, if it's within 10 feet of the ordinary high water mark. That triggers an Indiana DNR LARE permit under Indiana Code 14-26-2. Projects set well back from the water usually don't.
